Trouble with mp3 patents is not new. There are multiple people who claim to have invented the mp3 codec, and so using that technology commercially has always been a nightmare. Franhaufer I think is the company from which one can buy licenses to use this technology.
There is a better and free (free as in freedom) codec called Ogg Vorbis that can be used instead of mp3. This is a codec that is free from patents. You can find more about it at www.vorbis.com.
